This Privacy Policy applies to the T3 Micro online shop T3micro.com, including subdomains (“T3 Micro Shop“) and details information that T3 Micro, Inc, 228 Main Street, Suite 12, Venice CA 90291 (“We”, “Our”, “Us”) collects, uses and discloses about our users, including you.

SECTION 2 - SUBJECT MATTER OF DATA PROTECTION

Subject matter of this privacy policy is the collection and use of personal data. According to Art. 4 No. 1 GDPR, ‘Personal Data’ means any information relating to an identified or identifiable natural person; this includes, for example, your first and last name, telephone number, and email address or identification numbers. Anonymous Information does not identify you, such as statistical data about how you use T3 Micro.

SECTION 3 - COLLECTION AND USE OF YOUR PERSONAL DATA

3.1 - T3 Micro Shop We provide you with the T3 Micro Shop and with the technical infrastructure like your user account and the website. If you create a user account we collect your personal information (such as your name, your email and your shipping address) in order to create your account and to provide you with all features you would like to use on our website. We also store your order history for a period of 5 years in order to allow you to review your previous orders, e.g. in case of warranty claims or to re-buy a product you have liked in the past. We process this data in order to provide you these features in accordance with our terms and conditions (Art. 6(1) point (b) GDPR).

If you buy a product on the T3 Micro Shop, you purchase the product from our partner Moduslink. In order to allow you to buy products from Moduslink, we transfer the required data, such as your name, your shipping address and your order to Moduslink to fulfil your order. The legal basis for this disclosure of personal data to Moduslink is Art. 6(1) point (b) GDPR.

In some cases, you are required to provide us with certain personal data because we need this information so we can place your order. In this event, we cannot provide the according service unless you provide us with this personal data. If personal data is mandatory to enter into a contract, the respective input fields are marked with an asterisk.

3.2 - Collection of data by automated means When accessing our website, your device automatically transmits data for technical reasons. The following data is stored separately from other data that you may transmit to us:

  • Date and time of accessing our website
  • Browser type and version
  • Operating system
  • URL of the previously visited website (Referrer)
  • Amount of data sent
  • This data is stored exclusively for technical reasons and is not matched to a specific person at any time.

    3.3 - Contact form / Enquiries

    If you send us enquiries via our contact form or by email, your entries from the contact form including the contact data (name, email address, subject, message) you provide there will be stored and used for processing the enquiry. You do not have to enter your real name, a pseudonym is sufficient.

    We collect this data in order to be able to receive and process your request, Art. 6(1) point (b) GDPR. We store your data for a time period of 5 years unless you ask us to delete your data earlier.

    If we process your data as described above for the purpose of receiving and processing your request, you are obliged to make this data available to us. Without this data we are not able to provide you with the contact form or process your enquiries.

    SECTION 4 - PAYMENTS

    SECTION 5 - COOKIES

    We store so-called "Cookies" in order to offer you a comprehensive range of functions and to make the use of our websites more convenient.     SECTION 6 - GOOGLE ANALYTICS

    We use Google Analytics, a web analysis service of Google LLC ("Google"). Google Analytics uses "cookies", which are text files placed on your end-device, to help the website analyze how users use the website. The information generated by the cookie about your use of the website (including your shortened IP address) will be transmitted to and stored by Google on servers in the United States. There is no adequacy decision of the European Commission for the United States. However, Google LLC is certified under the Privacy Shield Framework.     Google will use the aforementioned information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to your use of the website and the Internet.     SECTION 7 - REMARKETING

    If you give us your consent, we use remarketing technologies in order to effectively advertise the products listed in the T3 Micro Shop. Remarketing technologies use cookies to store which products you have accessed in our shop and to display corresponding advertisements for such products to you when you visit other websites.

    SECTION 8 - NEWSLETTER

    We offer a free newsletter about our products and other personalized commercial communications from T3. You can subscribe to our newsletter by clicking the respective checkbox in the checkout process, subscribing via an on-site popup, on footer of the website, or on select product detail pages. We will then send you an email to confirm your subscription. You will only receive our newsletter if you have confirmed your subscription.

    We process your personal data based on the consent you give us when you subscribe to our newsletter (Art. 6(1) point (a) GDPR). You can withdraw your consent at any time by clicking the Link “unsubscribe” in our newsletters.

    SECTION 9 - EMAIL TRACKING

    If you give us your consent, we use e-mail tracking technologies to obtain information whether and when our emails have been actually read. To obtain this information, our emails contain an invisible pixel which tracks when an email has been opened.

    We use this technology based on your consent (Art. 6(1) point (a) GDPR). You can withdraw your consent at any time by unsubscribing from our email list utilizing the “unsubscribe” button in the footer of our email.

    SECTION 10 - SOCIAL MARKETING

    We use Facebook Custom Audiences, a service provided by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland or, if you are outside the EU, by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. Custom Audiences allows us to display Facebook ads to a target group which is similar to the users of the T3 Micro Shop. Therefore, we use the Facebook pixel which identifies you as a member of a target group and which helps Facebook to identify other users who have certain similar features (e.g. interests in certain topics or products). The Facebook pixel also helps us understand the effectiveness of Facebook ads for statistical and market research purposes by showing whether users have been redirected to our website after clicking on a Facebook ad.

    SECTION 11 - TRANSFER OF PERSONAL DATA TO THIRD PARTIES

    Unless stated otherwise in this privacy policy your personal data will only be passed on without your express prior consent in the following cases:

  • If it is necessary to discover or investigate any illegal use of our services or for prosecution, personal data will be forwarded to the law enforcement authorities and, if necessary, to injured third parties. However, this only happens if there are specific indications of illegal or abusive activity. A transfer may also take place if this serves to enforce terms of use or other agreements. We are also legally obliged to provide information to certain public authorities upon request. These are law enforcement authorities, authorities that prosecute fined administrative offences and the tax authorities.
  • The transfer of this data is justified by our legitimate interest in combating abuse, prosecuting criminal offenses and securing, asserting and enforcing legal claims and that your rights and interests in protecting your personal da-ta do not prevail, Art. 6(1) point (f) GDPR.
  • For the provision of services, we are depending on contractually affiliated external companies and external service providers set out in this privacy policy ("processors"). In such cases, personal data will be transferred to these processors in order to enable them to process the data further. These processors are carefully selected and regularly reviewed by us to ensure that your privacy is protected. The processors may only use the data for the purposes specified by us and are also contractually obligated to treat your data in accordance with this privacy policy and applicable data protection laws

Whenever personal data is passed on to third parties to the described ex-tent, we ensure that this is done in accordance with this data protection declaration and the relevant data protection laws.
  • A possible transfer of data is in these cases justified by our legitimate inter-est in adapting our company form and adapting the operation of our website to the economic and legal circumstances as required and that your rights and interests in the protection of your personal data do not prevail, Art. 6(1) point (f) GDPR.


  • SECTION 12 - AUTOMATED INDIVIDUAL CASE DECISIONS AND MEASURES FOR PROFILING

    We do not use automated processing procedures to bring about a decision or profiling.

    SECTION 13 - DELETION OF YOUR DATA

    We delete or make your personal data anonymous as soon as they are no longer required for the purposes for which we have collected or processed them in accordance with the above paragraphs. As a general rule and unless stated otherwise in this privacy policy, we store your personal data for the duration of the usage or contractual relationship via the website plus a period of 7 days in which we store backup copies after erasure, unless this data is required longer for legal reasons or for criminal prosecution or to secure, assert or enforce legal claims.

    14.3 - Right to erasure

    You have the right to have us delete personal data concerning you under the conditions described in Art. 17 GDPR. These conditions provide in particular for a right of erasure if the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed and in cases of unlawful processing, the existence of an objection or the existence of an obligation to erase under Union law or the law of the Member State to which we are subject.     You have the right to have us restrict processing of your personal data in accordance with Art. 18 GDPR.
